Terms of Use
These Terms of Use (“Terms”) govern your use of the Kinleaf mobile application and related services (the “Service”) provided by Bytendril (“we,” “us,” or “our”). By using Kinleaf, you agree to these Terms and our Privacy Policy.
1. The Service
Kinleaf helps you track plant care, predict watering needs from your observations, receive reminders, optionally share a family garden, and use AI-assisted care suggestions. Care guidance is informational only — it is not professional horticultural, medical, or emergency advice. You are responsible for decisions about your plants and property.
2. Eligibility and accounts
- You must be at least 13 years old to use Kinleaf.
- A Kinleaf account (Apple, Google, or email sign-in) is required for cloud sync, family gardens, and AI features after onboarding.
- You are responsible for activity on your account and for keeping your sign-in methods secure.
- You may delete your account at any time in Settings. Deletion is permanent for cloud data we control.
3. Subscriptions and billing
Kinleaf requires an active Kinleaf Pro subscription or eligible free trial to use the app after onboarding, except when you join a family garden as a member whose garden owner has an active subscription (family access).
- Plans — monthly and yearly auto-renewing subscriptions are offered through the Apple App Store and Google Play.
- Free trial — a 3-day free trial may be available on the yearly plan for eligible new subscribers. Trial length and eligibility are determined by the store and shown at purchase time.
- Billing — payment is charged to your store account. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
- Manage or cancel — use your device’s subscription settings (Apple: Settings → Apple ID → Subscriptions; Google: Play Store → Subscriptions). Deleting your Kinleaf account does not cancel a store subscription.
- Restore purchases — use “Restore purchases” in the app if you reinstall or change devices.
- Refunds — handled by Apple or Google under their policies, not directly by Bytendril.
4. Acceptable use
You agree not to:
- Use Kinleaf for unlawful purposes or to harass others
- Attempt to access another user’s account or data without permission
- Reverse engineer, scrape, or overload the Service
- Share invite codes publicly in a way that compromises garden security
- Misuse the Care Assistant to generate harmful or abusive content
5. Family gardens
If you create or join a family garden, you understand that plant and care data may be visible to other members according to their role. The garden owner can remove members. If you own a garden with other members, you must remove them before deleting your account.
6. AI Care Assistant
AI responses are generated automatically and may be incomplete or incorrect. Always use your judgment. Do not rely on Kinleaf for safety- critical decisions. We may limit AI usage (for example daily request caps) to keep the Service reliable.
7. Your content
You retain ownership of plant names, notes, and care logs you enter. You grant us a license to host, process, sync, and display that content as needed to operate Kinleaf, including sharing within gardens you join.
8. Intellectual property
Kinleaf, including its design, plant characters, software, and branding, is owned by Bytendril and protected by law. These Terms do not grant you any right to our trademarks or code.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT WATERING PREDICTIONS OR AI SUGGESTIONS WILL BE ACCURATE OR THAT THE SERVICE WILL BE UNINTERRUPTED.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BYTENDRIL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR PLANTS, ARISING FROM YOUR USE OF KINLEAF. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.
11. Termination
You may stop using Kinleaf at any time. We may suspend or terminate access if you violate these Terms or if required for legal or security reasons.
12. Changes
We may update these Terms. We will post the new version at this URL and update the effective date. Material changes may also be communicated in the app where appropriate.
13. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence apply.
